Local 1238 Updates and Issues

Brothers and Sisters, We would like to take the time to update you on some of the issues that are pertinent to Local 1238 at this time. First, we would like to thank all of you for your support of Local 210 during their contract negotiations. They are continuing to negotiate with the Company and are still without a tentative agreement. Paul M. Simon, John Boulden, and Steve Newberry have been attending (and are members of) their Strategic Planning Committee meetings every Wednesday night. We have offered Local 210 our full support and will communicate to the members any further activities needing your participation. Secondly, we would like to make everyone aware of the situation at Delaware City Power Plant. On February 6, 2006, Valero (the new owner of the refinery) advised Conectiv Energy supervision that they are exercising their right within the Operations and Maintenance Agreement (between Conectiv and Valero) to give 9 months notice and terminate the contract. Basically, this means that Conectiv will no longer have employees on the Valero property. Conectiv has put a Human Resources team together to address the issues at Delaware City. The Officers of Local 1238 will be involved in meetings with Conectiv Energy to work through the contractual issues that will obviously arise in a situation of this magnitude. Our number one concern is to do what’s best for the employees that we represent. As we obtain further information on this subject, we will communicate to the members promptly. In regards to the Absenteeism Control Policy and Unum Provident, the Union met with the Company on 2/2/06 for the second step of the grievance procedure. We did not receive a reply from the Company in reference to these issues and per the contract; the Union has requested a third step grievance meeting on each of these issues. We will keep you posted on the progress made at these meetings and any further actions taken to resolve these grievances. In closing, we would like to thank the membership for the support we receive on a daily basis. Our Union Meeting will be held on 2/14/06 at the Holiday Inn on Rte. 273.
