Dear Member, We would like to take the time to update you on some of the outstanding issues that we have had as a Local over the past few months. In regards to the Absenteeism Control Policy, the third step of the grievance procedure was held on March 21, 2006. The Company denied our grievance and we filed for arbitration on March 31, 2006. The arbitration process takes a great deal of time therefore; we do not expect a resolution until fall of this year. As many of you are aware, on February 7, 2006, Valero (the new owner of the Delaware City Refinery) gave notice that they will be terminating the Operations and Maintenance Contract with Conectiv Energy. Currently, Valero has a meeting scheduled with PHI on April 11, 2006 to get a clear understanding of our benefits package so that we may move forward with negotiating a smooth transition for our employees who opt to continue their careers with Valero. Following the meeting with PHI, the Executives of Valero will be in contact with Local 1238 to facilitate a meeting to move forward with this process. The Union has created a core committee to for this process consisting of: President Steve Newberry, Business Manager John Boulden, Assistant Business Manager Paul M. Simon, & I.B.E.W. International Representative Paul J. Simon III. As the process moves forward, the committee will be adding members from the Delaware City Power Plant for expertise in the field.
